Campbell Conroy & O’Neil Obtains Dismissal of Personal Injury Action Against Delta

Kathy Guilfoyle and Emily Amrhein obtained an order dismissing all claims against Delta Air Lines in a personal injury action pending in federal court in Worcester, Massachusetts, captioned Michael Ricci v. Delta Air Lines, Inc. Although suit was filed in Massachusetts, the plaintiff was a Connecticut resident and the alleged injury occurred while the flight was enroute to Atlanta. After permitting limited choice of law discovery at the outset of the case, the parties briefed and the Court heard oral argument on the choice of law issue. Applying the “more significant relationship” test, the Court concluded that the Connecticut statute of limitations applied and that the plaintiff’s negligence and breach of contract claims were time barred. The Court then sua sponte dismissed the case.
