Campbell Conroy & O’Neil obtains summary judgment ruling

Katherine Hains successfully argued a summary judgment motion in Suffolk Superior Court and obtained summary judgment on behalf of GSTH Investment Group, Bijou nightclub. The Plaintiff claimed the Boston nightclub was responsible for injuries sustained in a shooting that occurred outside of the nightclub and argued that the defendant undertook a special duty to its patrons to protect against potential criminal acts of third parties. In her ruling, Judge Connelly found that the plaintiff failed to prove that GSTH owed the plaintiff a duty of care to protect against the unforeseeable criminal acts of third parties. Judge Connelly further agreed that there was no evidence in the record to show that GSTH voluntarily undertook this heightened duty of care by staffing the night club with security and police details or that GSTH had notice that a violent act may occur on the night of the alleged incident.
