Summary Judgment in Favor of Defendants in Breach of Contract Case

The court allowed a motion for summary judgment as to all claims related to the installation of solar panels. The plaintiff alleged breach of contract, breach of implied covenant of good faith and fair dealing, breach of warranty, negligence, unjust enrichment, negligent misrepresentation, fraud, and violations of Chapter 93A, sections 9 and 11. After taking various discovery including depositions of the plaintiff and relevant witnesses, the Court concluded Plaintiff failed to establish damages and therefore failed to prove an essential element of his claims. After a motion for reconsideration and hearing, the Court also entered summary judgment on Plaintiff’s only remaining claim under Chapter 93A, section 9, ruling Plaintiff failed to establish damages for this claim as well.
