Maggie Pastuszak, Christopher B. Parkerson, and Dan Ward recently secured a court room victory for Caterpillar Inc. and Milton CAT.  The case involved allegations of breach of warranty, negligence and violation of the MA Consumer Protection statute related to the sale and operation of a Caterpillar C-15 Diesel Engine.  After a 3-day hearing challenging the plaintiff expert’s ability to testify at trial, which significantly limited the scope of admissible evidence of the plaintiff’s alleged damages, and two days of jury trial, plaintiff agreed to voluntarily dismiss the case in exchange for Caterpillar’s agreement to waive costs and fees.
