Merck Secures Summary Judgement in NuvaRing Case

The Plaintiff alleged that she suffered an arterial stroke as the result of the use of Merck’s NuvaRing contraceptive. Judge Mark Mastroianni allowed Merck’s motion for summary judgment and dismissed all of the plaintiff’s claims in their entirety. In applying New Jersey law, Judge Mastroianni found that the plaintiff failed to overcome the “super-presumption” that Merck’s labeling, warnings and information provided with NuvaRing were adequate. Jim Campbell and Michelle Schaffer represented Merck in the case.
