Margaret Pastuszak obtained a judgment in favor of a foreign airline in Massachusetts state court on all claims arising from alleged flight delays and damage to baggage. While the Montreal Convention governs damages on international flights, the plaintiff sought to recover damages outside of the scope of the Convention. The court concluded that the plaintiff was not entitled to recover claims outside of the Convention and that she did not meet her burden of proof that the airline was liable for any of the baggage damages.
