P. Brandon Perkins and Jimmy Butler obtained summary judgment on behalf of a bar in a dram shop case that sought damages arising from a DUI accident. Plaintiff’s theory of liability rested on the assertion that the bar served the drunk driver a substantial number of drinks on multiple occasions giving rise to an inference that the bar had knowledge that the driver was habitually addicted to alcohol when it served him on the day of the accident. Because there was no competent substantial evidence in the record to give rise to a reasonable inference that the bar had prior knowledge of the driver’s habitual addiction, trial court granted summary judgment.
