Campbell Conroy & O’Neil Obtains Summary Judgment in a Negligent Security Action

June 2021

The Circuit Court for the 20th Judicial Circuit in Florida granted summary judgment in favor of a shopping mall in four related cases arising from a shooting incident occurring in the mall’s parking lot. Plaintiffs asserted that the mall was negligent by, inter alia, failing to hire an off-duty Sheriff’s detail to patrol the mall and failing to install security cameras in its parking lot. In granting summary judgment, the Court concluded that no reasonable jury would find in favor of Plaintiffs on the evidence presented because such evidence would require the jury to stack inference upon inference to find causation.
