Today the Florida Supreme Court issued an order adopting the federal summary judgment standard effective May 1, 2021. The Order amending Rule 1.510 is attached, as well as the Court’s decision in the Wilsonart case prompting the consideration of the standard. The impact of this rule change cannot be overstated. We expect that defendants will have a much more fair and equitable opportunity to obtain summary judgment in those cases lacking in evidence of negligence.
